Terms of Service
These terms are the agreement between you and zenski for using CareCircle. Please read section 3 in particular — it explains what CareCircle is not.
CareCircle is an organisational tool, not a medical one. It does not give medical advice, does not monitor anyone, and will not call for help. In an emergency, contact your local emergency service. Never delay seeking medical care because of something you read in this app.
1. The agreement
CareCircle is published by zenski ("we", "us"), operating from Nepal. By creating an account or using the app you agree to these terms and to our Privacy Policy. If you do not agree, please do not use CareCircle.
If you use CareCircle on behalf of an organisation, you confirm you are authorised to bind that organisation.
2. Who may use CareCircle
You must be at least 16 years old.
If you are under 18, you may use CareCircle only with the knowledge and permission of your parent or guardian, and you may enter another person's health information only where that parent or guardian has confirmed you are entitled to do so. We take this seriously: recording somebody else's medical history is a decision the law usually reserves to adults, and being a capable young carer does not by itself create that authority.
You must also be permitted to use the app under the laws that apply to you.
3. CareCircle is not medical advice
This section is the most important one in these terms.
- CareCircle records and organises what you tell it. It does not diagnose, does not recommend treatment, does not interpret symptoms or vital signs, and does not assess how serious anything is.
- It is not a medical device and has not been reviewed or approved by any medical regulator.
- It is not a monitoring or alerting service. Nobody at zenski watches your records. If a reading you enter is dangerous, the app will not know and will not raise the alarm.
- It is not for emergencies. Emergency profiles are a convenient place to keep information you may be asked for; they do not summon help. Call your local emergency number.
- Reminders are a convenience, not a safety mechanism — see section 7.
Always follow the instructions of a qualified health professional. Nothing in CareCircle replaces professional judgement, and decisions about medication and treatment remain yours and your clinician's.
4. Your account
Give accurate details when registering and keep them current. You are responsible for your password, for keeping a screen lock on your devices, and for everything done through your account. Tell us promptly at info.zenski@gmail.com if you think someone else has access. You can review active sessions and sign out other devices from Settings.
5. Care circles and roles
A care circle is a shared space for the people caring for one person. Everything you record is visible to the other members of that circle according to their role:
- Administrator — full access; can invite and remove members, change roles, manage circle settings, turn AI on or off, and hand administration to someone else.
- Caregiver — can read and record care information.
- Viewer — can read, but not change, the circle's records.
Invite only people who should see the care recipient's health information. Removing a member ends their access going forward; it does not withdraw what they have already seen or copied.
If the only administrator deletes their account, administration passes automatically to a remaining active member so the circle is not left unmanageable. If the last member leaves, the circle and its records are deleted.
6. Your responsibilities
You agree that:
- You have the right to record the health information you enter about another person — because they asked you to, because you hold power of attorney or an equivalent authority, or because you are their parent or guardian.
- You will tell that person their information is held in CareCircle, and who can see it, where they are able to understand it.
- The information you record is accurate to the best of your knowledge. Others will act on it.
- You will not rely on CareCircle as your only record of critical information such as prescriptions.
- You will comply with the laws that apply to you, including those on health records and privacy.
7. Reminders and notifications
Reminders depend on things outside our control: your device's clock and time zone, its battery-saving and permission settings, whether it is switched on, and the availability of Apple's and Google's notification services. Operating systems also limit how many reminders an app may schedule at once, so the app schedules the nearest ones first.
A reminder may therefore be late, or may not arrive at all. Do not rely on CareCircle as the sole safeguard for a medication dose or an appointment.
8. AI assistance
AI assistance is optional, off by default, and requires both an administrator to enable it for the circle and your own separate consent.
- It is a writing aid for text you select — rephrasing, summarising, translating. It is not a clinical tool and must not be used to make care decisions.
- Output may be wrong, incomplete or misleading. It is not verified by anyone, clinically or otherwise.
- You must read and confirm every suggestion. Nothing is saved automatically, and once you accept a suggestion the resulting record is yours.
- Availability, limits and the underlying provider may change, and the feature may be withdrawn.
9. Subscriptions and payment
CareCircle offers free features and an optional paid subscription.
- Purchases go through Apple's App Store or Google Play, under their terms. We never receive your card details.
- Subscriptions renew automatically until cancelled. Cancel at least 24 hours before the period ends, through your Apple or Google account settings — uninstalling the app does not cancel a subscription.
- If a free trial is offered, any unused part is forfeited when you buy a subscription.
- Refunds are handled by the store you purchased from, under its policy. We cannot issue refunds for purchases we did not process, though we will help where we can.
- We may change prices or what is included. Changes apply from your next renewal, and we will give you reasonable notice.
- If a subscription lapses, premium features stop but your care records remain accessible.
10. Acceptable use
You must not:
- Record another person's health information without the authority to do so;
- Use CareCircle to harass, control, surveil or endanger anyone;
- Upload malware, or content that is unlawful or infringes someone else's rights;
- Attempt to access another circle's data, probe or bypass our security, or interfere with the service;
- Reverse engineer, decompile or scrape the service, except where the law expressly allows it;
- Resell or commercially redistribute the service without our written permission;
- Use the app for clinical decision-making, or present it as a medical or monitoring service.
11. Your content
Your records remain yours. You grant us only the limited licence needed to host, store, back up, sync and display them so the app works for you and your circle. That licence ends when the content is deleted, apart from copies that persist briefly in routine backups.
The CareCircle name, design, and the software itself remain ours. These terms give you a personal, non-exclusive, non-transferable, revocable licence to use the app; they do not transfer any ownership.
12. Availability and data
We aim to keep CareCircle available and correct, but we provide it "as is". We may change, suspend or discontinue features, and we may need to take the service down for maintenance.
The app stores a copy of your data on your device and syncs when you reconnect, so short outages should not stop you recording care. If the same record is edited on two devices at once, the service protects the earlier edit and asks you to resolve the conflict rather than silently overwriting it.
Keep your own copy of anything you cannot afford to lose. Use the export feature in Settings. We take backups, but we do not guarantee that data can always be recovered.
13. Suspension and termination
You may stop using CareCircle at any time and delete your account from Settings. Deletion is scheduled seven days ahead and can be cancelled during that period; after that it cannot be undone.
When your account is erased, care records you wrote stay with the circle, with your name replaced. This is explained in section 8 of the Privacy Policy — those records are the care recipient's health history, and other caregivers depend on them.
We may suspend or terminate your access if you materially breach these terms, if we must for legal or security reasons, or if we discontinue the service. Except where the breach is serious or we are legally prevented, we will give you notice and a chance to export your data. Sections 3, 11 and 14 to 19 survive termination.
14. Disclaimers
To the fullest extent the law allows, CareCircle is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, non-infringement, and any warranty that the service will be uninterrupted, timely, secure or error-free, or that reminders will be delivered.
Nothing here excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep the statutory rights your local law gives you.
15. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for loss of profit, data, goodwill or opportunity, nor for any harm arising from:
- a reminder that was late, missing or wrong;
- a care decision made using information in the app, including AI output;
- information entered inaccurately by you or another member of your circle;
- access by someone you invited to a circle, or who used your device or account;
- failures of your device, your network, or Apple's or Google's services.
Where liability cannot be excluded, our total liability for all claims in any 12-month period is limited to the greater of the amount you paid us for CareCircle in that period, or USD 50.
16. Indemnity
You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms, your misuse of the service, or your recording of another person's information without the authority to do so.
17. Changes to these terms
We may update these terms. We will change the date and version above, and for material changes we will notify you in the app or by email before they take effect. Continuing to use CareCircle after that means you accept the new terms; if you do not, you may delete your account.
18. Governing law and disputes
These terms are governed by the laws of Nepal, and the courts of Nepal have exclusive jurisdiction, except that if you are a consumer resident elsewhere you keep the protection of your local mandatory laws and may bring proceedings in your local courts.
Please contact us first — most issues are resolved quickly by email.
19. General
These terms and the Privacy Policy are the whole agreement between us about CareCircle. If a provision is found unenforceable, the rest continues in force. Our not enforcing a right is not a waiver of it. You may not transfer these terms; we may transfer them to a successor of our business, and will tell you if we do.
Apple and Google are not parties to these terms and are not responsible for CareCircle. Apple's standard end-user licence terms apply in addition where you obtained the app from the App Store, and Apple may enforce these terms as a third-party beneficiary.
